General Terms and Conditions of Sale (GTC)

1. Introduction
These General Terms and Conditions of Sale govern the contractual relationship between Gaby Country, a sole proprietorship specializing in the creation and planning of tailor-made trips, and its individual or professional clients.
They apply to any personalized consulting, assistance, or organizational services provided by Gaby Country, including but not limited to the research of itineraries, accommodations, transportation, activities, or complementary travel-related services.
Gaby Country is not a travel agency and does not make any bookings of flights, stays, accommodations, or other services on behalf of its clients.
The advice and recommendations provided serve to guide and assist the client in their own booking procedures.
2. Services
Gaby Country offers personalized travel planning and advisory services based on the client’s needs, preferences, and constraints.
The services include, but are not limited to :

Research and creation of tailor-made itineraries;

Research and advice regarding transportation (flights, trains, vehicle rental, etc.);

Research and advice regarding accommodations;

Research and advice regarding activities, excursions, and local guides;

Research and advice regarding restaurants and other services;
-
Provision of practical information about the destination (formalities, health, safety, etc.);

Assistance and advice during the booking process;
-
Support before and during the trip.
Gaby Country does not carry out bookings on behalf of the client. The client remains solely responsible for making the suggested bookings (transportation, accommodation, activities, etc.) and for the associated payments.
The prices and availability of the suggested services are provided as an indication at the time of recommendation. They may fluctuate over time, independently of Gaby Country. The company cannot be held liable for any price variation, change in conditions, or unavailability occurring after the transmission of its recommendations.
3. Pricing and Payment Terms
The service fees are expressed in euros and vary depending on the nature and extent of the requested services.

A personalized quote is sent to the client electronically before any order confirmation. Payment is made in accordance with the terms specified in the quote (bank transfer, online payment or any other means agreed between the parties).

The client’s signature of the quote constitutes full acceptance of the General Terms and Conditions of Sale and confirmation of the order.

The service begins upon receipt of full payment or in accordance with the payment terms agreed in writing between Gaby Country and the client.

An invoice is sent to the client after receipt of payment.
Any request for modification after signing the quote must be made in writing and may result in additional fees.
Any substantial modification (for example: change of destination, dates, or itinerary requiring new research) will require a new quote, subject to validation before the service can resume.
4. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the client has a period of 14 days from the confirmation of their order to exercise their right of withdrawal, without having to justify their decision or pay any penalties.
However, in accordance with Article L221-28 of the same code, this right does not apply to services that have been fully executed before the end of the withdrawal period, or to personalized services whose execution has begun with the client’s consent.
Nevertheless, Gaby Country undertakes to review any cancellation or postponement request, whenever possible, if the service has not yet begun or if adjustments can be made without significant cost.
5. Cancellation, Postponement, and Late Payment
Cancellation or postponement by the client.
Any request to cancel or postpone a service must be made in writing (email or letter).
In the event of cancellation before the beginning of the service, any amounts already paid may be refunded (or partially refunded), subject to costs already incurred by Gaby Country (working hours, research, document preparation, etc.).
In case of postponement, a new agreement must be reached between the parties, and file revision fees may apply depending on the progress of the work.
Cancellation or modification by recommended service providers
Gaby Country acts solely as an independent advisory intermediary and does not make bookings on behalf of its clients.
The cancellation, modification, or refund policies applied by third-party providers (airlines, accommodations, local agencies, etc.) are their sole responsibility.
The client is invited to carefully review the terms and conditions of each provider before making any booking.
Gaby Country cannot be held liable for any modification, delay, cancellation, or failure by third-party providers (airlines, accommodations, local agencies...) or any other party involved in the organization of the trip.
Late payment
In the event of total or partial non-payment within the agreed timeframe, Gaby Country reserves the right to suspend the service until the situation is resolved.
Gaby Country acts strictly as an advisory intermediary and cannot be held responsible for the execution of the services provided by third-party entities (airlines, accommodations, local service providers...).
The client remains responsible for their final choices.
6. Liability
Gaby Country acts as a travel organization consultant.
Its mission is to assist the client in researching, selecting, and recommending service providers (accommodations, transportation, activities, etc.) based on the expressed needs.
Gaby Country does not intervene in the booking, payment, or management of agreements between the client and third-party providers.
Consequently, Gaby Country cannot be held liable in the event of :

modification, cancellation, delay, or failure by a third-party provider (airline, hotel, local agency, etc.);

issues related to the execution of a service booked directly by the client;
-
loss, theft, accident, or any other incident occurring before, during, or after the trip;
-
failure to comply with administrative or health-related travel requirements (passport, visa, vaccinations, etc.).
The client remains fully responsible for their booking decisions and for verifying the information provided by the service providers.

However, Gaby Country undertakes to provide quality service and reliable, up-to-date, and relevant recommendations based on the information available at the time of service.

It is strongly recommended that the client subscribe to travel insurance covering, among others, risks of cancellation, accident, illness, loss or theft of luggage.
7. Personal Data
The information collected from the client (first name, surname, email, phone number, travel preferences, etc.) is necessary for the proper performance of the service. It is processed confidentially and securely, in compliance with applicable regulations (GDPR).
This data is never sold nor shared with third parties, except when necessary to deliver the service and with the client’s consent.
The client has the right at any time to access, rectify or delete their data upon simple request sent to the following address: info@gabycountry.com.

8. Intellectual Property
All content on the website www.gabycountry.com, including texts, images, graphics, logos, icons, photographs, and the visual identity, are the exclusive property of Gaby Country unless otherwise stated.
Any reproduction, distribution, modification, or exploitation, even partial, without prior written consent, is strictly prohibited.
Items provided by the client (logos, texts, visuals, etc.) remain their property, and Gaby Country commits not to use them outside the scope of the agreed service.
9. Disputes
These General Terms and Conditions of Sale are governed by French law.
In the event of a disagreement or dispute, the parties shall attempt to resolve the matter amicably before taking legal action.
If no agreement can be reached, the dispute may be brought before the competent courts of the jurisdiction of Gaby Country’s registered office.
Privacy Policy

The information collected via the contact form (name, email, phone, message) is recorded for the sole purpose of being able to respond to requests.
No data is sold, rented or transmitted to third parties.
